1.7. “Renewals” refers to the extension of the registration period for a domain name or a hosting service.

1.8. “Transfers” refers to the process of transferring a domain name from one registrar to another.

1.9. “Acceptable Use” refers to the terms and conditions that must be followed by Users when using the Services, as outlined in section 6.

1.10. “Content” refers to any information, data, text, software, music, sound, photographs, graphics, videos, messages, or any other materials uploaded, posted, transmitted, or stored on or through the Services.

    3.2. Account Registration
    To access our Services, you must create an account on our platform. You agree to provide accurate and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities associated with your account.

    3.3. Availability
    Greenhost strives to provide uninterrupted access to our Services. However, we do not guarantee continuous availability due to factors beyond our control, including but not limited to maintenance, network issues, or force majeure events.

    3.4. Usage Restrictions
    You agree to use our Services in compliance with all applicable laws, regulations, and these Terms of Service. Any illegal activities, including but not limited to hacking, spamming, or distributing malicious software, are strictly prohibited. Greenhost reserves the right to suspend or terminate your account without prior notice if we reasonably believe that you have engaged in illegal activities or violated these Terms.

4.1 Domain Registration

4.1.1 Greenhost, in cooperation with Connectreseller.com, offers domain registration services for a wide range of top-level domains (TLDs) as part of our hosting packages.

4.1.2 By using Greenhost’s domain registration services, you agree to abide by the terms and conditions set forth by both Greenhost and Connectreseller.com. These terms may include specific requirements, limitations, and regulations imposed by the appropriate domain registration authorities.

4.1.3 Greenhost and Connectreseller.com act solely as intermediaries facilitating the registration process between the customer and the relevant domain registration authorities. We cannot guarantee the availability of any requested domain name, as it is subject to the registry’s approval.

4.2 Domain Renewals

4.2.1 Greenhost provides domain renewal services to ensure the continuity of your registered domain(s). It is your responsibility to ensure timely payment of renewal fees to avoid domain expiration.

4.2.2 We will send renewal reminders to your registered email address as a courtesy, but it is ultimately your responsibility to keep track of your domain renewal dates.

4.3 Domain Transfers

4.3.1 Greenhost supports domain transfers to facilitate the migration of your domain(s) from another registrar to our services. However, please note that certain TLDs may have specific transfer requirements or restrictions imposed by the registry.

4.3.2 To initiate a domain transfer, you must provide Greenhost with the necessary authorization codes, authentication tokens, or any other information required by the registry to approve the transfer.

4.3.3 Greenhost will not be responsible for any failed or delayed transfers arising due to inaccurate or incomplete transfer information provided by the customer.

4.4 Domain Transfer Disputes

4.4.1 In the event of a domain transfer dispute, Greenhost will comply with applicable regulations and policies set forth by the relevant domain registration authorities.

4.4.2 Greenhost may provide reasonable assistance, upon your request, to help resolve transfer disputes. However, the ultimate decision lies with the respective domain registration authority, and Greenhost cannot guarantee the outcome of such disputes.

5.1 Acceptable Use
You agree to use our services solely for lawful purposes and in accordance with the terms set forth in this Agreement. Therefore, activities that are illegal, abusive, fraudulent, or violate the rights of third parties are strictly prohibited. This includes but is not limited to, engaging in activities such as hacking, unauthorized access, distribution of malware, phishing, spamming, and any other activity deemed unlawful or unauthorized.

5.2 Content
You are solely responsible for the content you publish or host on our platform. You agree not to upload, post, or transmit any content that is defamatory, obscene, infringing, or violates the rights of others, including intellectual property rights. Furthermore, you acknowledge that our services shall not be used to store or distribute content that promotes violence, discrimination, or any content that could be categorized as hate speech.

5.3 Behavior
You agree to adhere to appropriate online conduct and treat our staff and other users with respect. Prohibited behavior includes, but is not limited to, engaging in harassment, stalking, or creating a hostile environment for others. Any form of behavior that is deemed offensive or violates ethical standards will not be tolerated.

5.4 Monitoring and Enforcement

However, you are responsible for maintaining the confidentiality of your account login credentials and are solely responsible for all activities that occur under your account.

6.2. You agree to:

6.3. Greenhost reserves the right to suspend or terminate your account, without notice, if we suspect any unauthorized or illegal activity involving your account or breach of security measures. In such cases, we may also undertake any necessary actions to protect our systems, other users, or third parties.

6.4. Greenhost shall not be liable for any loss or damage arising from your failure to comply with the account security obligations outlined in this section or if unauthorized access to your account occurs.

    8.6 Billing Inquiries and Disputes

9.5. Greenhost reserves the right to modify the VAT rates or policies in accordance with any changes imposed by the relevant tax authorities. Any such modifications will be communicated to customers in a timely manner.

9.6. It is the responsibility of the customer to ensure the accuracy and validity of the provided VAT numbers, if applicable. Greenhost will not be held liable for any errors or inaccuracies in VAT numbers provided by customers.

9.7. In case of any disputes or discrepancies regarding VAT charges or exemptions, customers are advised to contact our customer support for assistance. We will endeavor to resolve such issues in a fair and timely manner, working within the legal framework determined by the relevant tax authorities.

10.1 Cancellations
We understand that circumstances may change, and you may need to cancel your services with us. In such cases, you may cancel your services by submitting a cancellation request through our designated channels. Please refer to the “Contact Us” section on our website for the specific process.

10.2 Refunds
We strive to provide a satisfactory experience to our customers, and in line with this commitment, we offer a 30-day money-back guarantee on our services. If you are not completely satisfied with the service within the first 30 days of your initial purchase, you may request a refund.

10.7 Disputes and Arbitration
Any disputes or issues concerning cancellations and refunds will be subject to the resolution methods described in section 21 (Law).

11.1 Greenhost offers a 30-day money-back guarantee on all our hosting services, subject to the terms and conditions outlined in this section and other relevant sections of the terms of service.

11.2 To initiate the money-back guarantee, you must submit a cancellation request within 30 days of the commencement of your service. The cancellation request must be made through the designated channels specified by Greenhost.

11.3 This money-back guarantee only applies to the hosting service fees and does not include any additional services, such as domain registration or add-ons, which are non-refundable.

11.4 In the case of domain registration, renewals, and transfers, these services are governed by separate policies, which may have their own refund terms and conditions.

11.5 Greenhost reserves the right to deny refund requests if any illegal activity, violation of acceptable use policies, or breach of the terms of service has occurred.

11.6 The refund will be processed within a reasonable time after the cancellation request is approved and will be issued via the original payment method used for the initial purchase.

11.7 Greenhost holds the right to modify or discontinue the money-back guarantee at any time, with or without prior notice. Changes to the money-back guarantee will not affect any requests submitted before the modification or discontinuation takes effect.

12.1 Client Data
(a) Greenhost recognizes and acknowledges that the data uploaded or provided by the client (“Client Data”) through our services is valuable and confidential. Client Data includes but is not limited to website content, databases, emails, files, and any other data stored or transmitted through our servers.
(b) Greenhost shall take all reasonable measures to ensure the security, integrity, and privacy of Client Data, in accordance with applicable legal obligations, including the General Data Protection Regulation (GDPR) and the UK and Denmark law.

12.2 Backup Services
(a) Greenhost shall perform regular backups of Client Data for disaster recovery purposes. However, these backups are not guaranteed and may not always be available or up-to-date.
(b) It is the responsibility of the client to maintain independent backups of their Client Data. Greenhost strongly recommends that clients regularly back up their data to ensure its integrity and availability.

12.3 Data Loss or Corruption
(a) Greenhost shall not be responsible for any loss or corruption of Client Data, whether due to accidental deletion, unauthorized access, failure of hardware or software, or any other cause.
(b) Greenhost shall not be liable for any damages, financial or otherwise, incurred by the client due to the loss or corruption of Client Data.

12.4 Restoration of Client Data
(a) In the event of data loss or corruption, Greenhost will make reasonable efforts to assist the client in restoring their Client Data from the most recent available backup.
(b) However, Greenhost does not guarantee the restoration of all Client Data or the complete resolution of data loss or corruption.

12.5 Client Responsibilities
(a) The client is solely responsible for the accuracy, legality, and compliance of their Client Data with applicable laws and regulations.
(b) The client acknowledges that they have appropriate legal rights and permissions to use, store, and transmit the Client Data through our services.

13.1. Greenhost provides a certain amount of bandwidth as a part of its hosting plans. Bandwidth refers to the amount of data that can be transferred between your website and its visitors within a specific time period.

13.2. The specific bandwidth allocation for each hosting plan is outlined in the plan details on our website. You are responsible for monitoring your bandwidth usage to ensure it remains within the allocated limit.

13.3. If your website exceeds the allocated bandwidth limit, Greenhost reserves the right to take appropriate actions, which may include throttling or suspension of services until the excess bandwidth is resolved or you upgrade to a higher plan with increased bandwidth.

13.4. Bandwidth usage is calculated based on incoming and outgoing data, including but not limited to website traffic, emails, file transfers, and other interactions through your hosting account.

13.5. Greenhost continuously works to maintain sufficient network capacity to accommodate high levels of traffic and ensure optimal performance for all customers. However, we do not guarantee unlimited bandwidth or uninterrupted data transfer.

13.6. Bandwidth throttling or suspension due to excessive usage does not make you eligible for any refunds or compensation.

13.7. Greenhost reserves the right to monitor and analyze bandwidth usage on its servers to ensure fair usage and prevent abuse or excessive resource consumption that may disrupt the hosting environment for other customers.

14.1 Greenhost is committed to providing a high level of service availability and uptime for our customers. This section outlines the terms and conditions of our Uptime Service Level Agreement (SLA).

14.2 Uptime Guarantee:
(a) Greenhost guarantees a minimum of 99.9% uptime for our hosting services, excluding scheduled maintenance and any factors beyond our reasonable control.
(b) In the event that our uptime falls below the guaranteed level, customers may be entitled to credits or remedies as outlined in this section.

14.3 Monitoring and Notifications:
(a) Greenhost continuously monitors the availability of our servers and network infrastructure.
(b) In the event of an outage or significant performance degradation, Greenhost will make reasonable efforts to promptly notify affected customers via email or other communication methods.

14.4 Remedies:
(a) In the event of an uptime outage qualifying for compensation, customers may be eligible for service credits as determined by Greenhost.
(b) Service credits will be applied to the customer’s account and may be used towards future invoice payments or service upgrades.
(c) The amount of service credits will be calculated based on the percentage of uptime loss and will be determined solely by Greenhost.

14.5 Exclusions and Limitations:
(a) The Uptime SLA does not cover downtime or service interruptions caused by factors outside of Greenhost’s control, including but not limited to acts of nature, internet outages, or unauthorized access to customer accounts.
(b) Greenhost shall not be liable for any damages or losses, including but not limited to loss of data or business interruption, arising from or related to uptime issues.

14.6 Reporting and Claims:
(a) Customers must promptly report any uptime issues to Greenhost’s support team.
(b) Claims for service credits must be submitted within 30 days from the time of the reported incident.
(c) Claims must provide sufficient evidence and details regarding the nature and duration of the outage.

14.7 Limitation of Liability:
(a) Greenhost’s liability for any breaches of the Uptime SLA is limited to the amount equivalent to the fees paid by the customer for the affected services during the period of the outage.
(b) Greenhost shall not be liable for any indirect, consequential, or incidental damages arising from or in connection with uptime issues.

15.1 Termination by Greenhost: Greenhost reserves the right to terminate or suspend your services and access to our platform in the event of a breach of any terms and conditions outlined in this Term of Service. We may terminate your account without prior notice if we determine that you have engaged in any illegal activities or violated any applicable laws.

15.2 Effect of Termination: Upon termination, your access to the services and platform provided by Greenhost will be immediately revoked. You acknowledge and agree that Greenhost shall not be liable to you or any third party for any termination of your account or access to our services.

15.3 Our responsibility for loss or damage suffered by you if you are a consumer: If you are a consumer and the termination of your account or access to our services is due to our negligence or breach of these terms, we will be responsible for any direct loss or damage you suffer as a result, up to the total amount you have paid for the services during the twelve (12) months prior to the termination.

15.4 Our responsibility for loss or damage suffered by you if you are a business: If you are a business and the termination of your account or access to our services is due to our negligence or breach of these terms, we will be responsible for any direct loss or damage you suffer as a result, up to the total amount you have paid for the services during the six (6) months prior to the termination.

15.5 Delays: Greenhost shall not be liable for any delays or failure to perform its obligations under this Term of Service, including termination of services, caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, power outage, or governmental actions.

15.6 Indemnity: You agree to indemnify and hold Greenhost harmless from any claims, costs, damages, or liabilities arising out of or related to your use of our services and violation of any terms and conditions outlined in this Term of Service.

15.7 Law: This Term of Service shall be governed by and construed in accordance with the laws of the UK and Denmark. Any disputes arising from or in connection with this Term of Service shall be subject to the exclusive jurisdiction of the courts of the UK and Denmark.

15.8 Modification of Terms of Service: Greenhost reserves the right to modify and update this Term of Service from time to time. Any changes will be effective immediately upon posting on our website. It is your responsibility to regularly review this Term of Service to stay informed of any updates or modifications.

Upon termination of services, whether initiated by the client or Greenhost, the following actions will be taken:

16.1 All access to the client’s account and services will be immediately terminated.

16.2 Greenhost will delete all client data from its servers, unless otherwise requested by the client in writing.

16.3 Greenhost will not be held responsible for any loss or damage incurred by the client as a result of the termination.

16.4 Any outstanding invoices or fees must be settled in full within the specified timeframe. Failure to do so may result in legal action being taken.

16.5 Greenhost reserves the right to retain any domain names registered on behalf of the client until all outstanding payments have been cleared.

16.6 Upon termination, the client will no longer have access to any backups or data stored on Greenhost servers. It is the client’s responsibility to ensure they have a backup of their data before terminating the services.

16.7 Greenhost will not be liable for any loss, damage, or inconvenience caused to the client or any third party as a result of the termination of services.

16.8 Greenhost reserves the right to suspend or terminate services at any time, without prior notice, if the client is found to be engaging in illegal activities, violating the terms of service, or causing harm to the server or network infrastructure.

17.1 We take our responsibility to provide reliable and secure services seriously. However, you should be aware of certain limitations and exclusions on our liability specified in this section.

17.2 Limitation of Liability:

17.2.1 We shall not be liable for any loss or damage incurred by you if it results from:

(a) Your improper use of our services, violating the terms set forth in Section 5 – Acceptable Use, Content, and Behaviour;
(b) Any unauthorized access or actions from a third party to your account due to your negligence in maintaining the security of your account, as outlined in Section 6 – Account Security;
(c) Any force majeure event or circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, or acts of government authorities;
(d) Any losses or damages caused by your failure to comply with your legal obligations under the General Data Protection Regulation (GDPR), as stated in Section 7 – Data Protection (GDPR);
(e) Any losses or damages arising out of the termination of your services, as explained in Section 16 – Termination.

17.2.2 In any event, our liability to you for any direct losses or damages suffered by you as a consumer shall not exceed the total amount paid by you for the services within the six-month period immediately preceding the date on which the act or omission occurred.

17.3 Exclusion of Consequential and Indirect Losses:

17.3.1 To the extent permitted by law, we shall not be liable for any indirect, special, or consequential losses or damages suffered by you as a consumer, including without limitation, loss of profits, revenue, business, data, or reputation.

17.4 Consumer’s Statutory Rights:

17.4.1 Nothing within these Terms of Service shall affect your statutory rights as a consumer, nor shall it exclude or limit our liability for any matter in which it is unlawful to exclude or limit liability.

17.5 Notices:

17.5.1 If you have any claims or believe that we are liable for any losses or damages, you must notify us promptly in writing.

17.5.2 We will investigate your claim and will endeavor to resolve any dispute or complaint amicably and in a timely manner.

17.6 Third-Party Services:

17.6.1 We are not responsible for any losses or damages incurred by you arising from third-party services or products, even if they are recommended or referred to by our platform or support team.

17.6.2 Any disputes related to third-party services or products should be resolved directly with the relevant third-party provider.

18.1 Greenhost shall not be liable to you, as a business, for any loss or damage, including, without limitation, any indirect, consequential, special, or exemplary damages arising out of or in connection with your use of our services, whether based on contract, tort (including negligence), strict liability or otherwise, even if Greenhost has been advised of the possibility of such damages.

18.2 Greenhost’s total liability to you, as a business, for any claim arising out of or in connection with our services or these terms of service, whether based on contract, tort (including negligence), strict liability or otherwise, shall be limited to the amount paid by you to Greenhost for the particular service giving rise to the claim in the twelve (12) months preceding the claim.

18.3 You agree to indemnify and hold Greenhost harmless from and against any and all liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with any claim or demand made by any third party due to or arising out of your use of our services, violation of these terms of service, or your violation of any rights of another.

18.4 Greenhost will not be responsible for any loss, damage, or interruption of service as a result of any force majeure event, including but not limited to acts of God, government actions, wars, riots, civil disruptions, natural disasters, terrorist attacks, or any other circumstances beyond our reasonable control.

18.5 Nothing in these terms of service shall limit or exclude Greenhost’s liability for:

  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot be excluded or limited under applicable law.

18.6 You acknowledge and agree that the limitations and exclusions of liability in section 18 are fair and reasonable in view of the nature of the services provided by Greenhost and their associated risks.

19.1 Greenhost shall not be held liable for any delays or failures in the provision of services due to circumstances beyond its reasonable control, including but not limited to acts of God, government regulations, power failures, natural disasters, or any other events that are beyond our control (“Force Majeure Events”).

19.2 In the event of a Force Majeure Event, Greenhost will make reasonable efforts to minimize any resulting service disruptions or delays and to notify affected customers promptly.

19.3 In the event of a delay or disruption caused by a Force Majeure Event, Greenhost shall not be held responsible for any loss or damage incurred by the customer, including but not limited to loss of data, loss of business, or other consequential damages. Customers are encouraged to implement their own backup and disaster recovery measures to mitigate potential losses.

19.4 If the delay or disruption caused by a Force Majeure Event persists for a prolonged period, either party may terminate the affected services without penalty. Termination should be carried out following the procedures outlined in Section 15 – Termination.

19.5 For delays or disruptions not caused by a Force Majeure Event, Greenhost shall make reasonable efforts to promptly rectify the situation and resume normal service.

20.1 You agree to indemnify and hold Greenhost, its affiliates, and their respective directors, officers, employees, agents, and partners harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with:

  1. a) Your breach of any provision of this Terms of Service;
    b) Your use of the Services and any content or data transmitted or received by you;
    c) Your violation of any law or regulation;
    d) Your infringement of any intellectual property or other rights of any third party; or
    e) Any unauthorized use of your account, regardless of whether such activities were undertaken by you or any third party using your account.

20.2 Greenhost shall have the right to select and retain its own legal counsel, and you agree to cooperate fully with Greenhost in the defense of any claim that is the subject of your indemnification obligations herein.

20.3 Greenhost reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with any reasonable requests assisting Greenhost’s defense of such matter.

21.1 These Terms of Service and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Kingdom and Denmark.

21.2 Any legal action or proceeding concerning these Terms of Service or any claims arising from the use of our services shall be brought exclusively in the courts located in the United Kingdom (for customers based in the UK) or Denmark (for customers based in Denmark).

21.3 If you are a consumer based outside of the United Kingdom or Denmark, the laws of your country may also apply, and any disputes shall be subject to the exclusive jurisdiction of the courts of your country.

21.4 Any provision of these Terms of Service that is judged to be illegal, void, or unenforceable shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of the remaining provisions.

21.5 The headings and titles in these Terms of Service are for convenience only and shall have no legal effect.

21.6 These Terms of Service, along with our Privacy Policy and any specific terms applicable to individual services, constitute the entire agreement between you and Greenhost regarding your use of our services. Any failure by us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

At Greenhost, we reserve the right to modify these Terms of Service at any time without prior notice. It is your responsibility to review these terms to ensure that you are aware of any changes. Modifications may include but are not limited to, changes in pricing, billing procedures, service offerings, or any other aspect of our services. By continuing to use our services after any modifications have been made, you agree to be bound by the updated terms. If you do not agree with the modifications, you may terminate your account in accordance with the Termination section (15) of these Terms of Service.

We understand that changes to our Terms of Service may have implications for your usage and relationship with Greenhost. Therefore, we will make reasonable efforts to notify you of any material changes via email or by posting a notice on our website. However, it is ultimately your responsibility to familiarize yourself with the updated terms.

Please note that in the event of any conflict or inconsistency between these Terms of Service and any additional agreements you may have with Greenhost, the provisions of these Terms of Service will prevail unless explicitly stated otherwise.
